In accordance with the provisions of Law No. 6698 on the Protection of Personal Data (KVKK), all types of information that identify or can identify you will be processed as Personal Data by ACT Yurtdışı Eğitim Danışmanlığı, in the capacity of Data Controller, within the scope defined below. The term “Processing of Your Personal Data” refers to any operation performed on such data, such as obtaining, recording, storing, preserving, modifying, rearranging, disclosing, transferring, taking over, making available, classifying, or preventing its use.

The Law on the Protection of Personal Data No. 6698 was published in the Official Gazette dated 07.04.2016 and numbered 29677. If personal data had been lawfully obtained by our company before the law came into effect, such personal data will continue to be processed and stored in accordance with the provisions and conditions specified in the KVKK and this Information Text.

As ACT Yurtdışı Eğitim Danışmanlığı, we would like to emphasize that we attach the utmost importance to the security of your personal data and continue our operations with full awareness of maintaining the protection and confidentiality of your personal data in all the services we provide.

During the use of your personal data within our services, the protection of your privacy and your fundamental rights and freedoms is our main principle.

Purposes and Legal Grounds for Processing Your Personal Data:
Within the framework of the laws and relevant regulations to which our company is subject, your personal data may be processed for the purposes of providing services to you, performing our operations, identifying the owner and the recipient of each transaction, registering information such as your identity, address, phone number, tax number, and other relevant details as personal data under the KVKK, preparing documents that will serve as the basis for transactions carried out on paper or electronically, fulfilling our legal obligations regarding data retention, reporting, and providing information to judicial and administrative authorities as required by the relevant legislation, and delivering other services offered or requested from our company.

According to Article 5(2) of the KVKK titled “Conditions for Processing Personal Data,” personal data may be processed without the explicit consent of the data subject if one of the following conditions applies:

a. Explicitly stipulated by law.
b. Necessary to protect the life or physical integrity of the person who is unable to express consent due to actual impossibility or whose consent is not legally valid.
c. Necessary for the establishment or performance of a contract to which the data subject is a party.
d. Necessary for the data controller to fulfill its legal obligation.
e. The personal data has been made public by the data subject.
f. Necessary for the establishment, exercise, or protection of a legal right.
g. Necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Transfer of Your Personal Data:
Even without the explicit consent of the personal data owner, personal data may be transferred to third parties by our Company, provided that one or more of the conditions listed below are met and that all necessary security measures, including those prescribed by the Board, are taken:

a. The activity related to the transfer of personal data is explicitly provided for by law.
b. The transfer of personal data is directly related to and necessary for the establishment or performance of a contract.
c. The transfer is necessary for our Company to fulfill its legal obligations.
d. Provided that it has been made public by the data subject, the data may be transferred for the purpose of public disclosure.
e. The transfer is necessary for the establishment, exercise, or protection of the rights of our Company, the data subject, or third parties.
f. The transfer is necessary for the legitimate interests of our Company, provided that it does not violate the fundamental rights and freedoms of the data subject.
g. Necessary to protect the life or physical integrity of a person who is unable to express consent due to actual impossibility or whose consent is not legally valid.

Additionally, personal data may be transferred to foreign countries declared by the Board to have adequate protection (“Foreign Countries with Adequate Protection”) if any of the above conditions apply. In cases where adequate protection is not available, data may be transferred to foreign countries where both the data controllers in Turkey and the relevant foreign country have provided a written commitment of adequate protection and obtained the Board’s permission (“Foreign Country Whose Data Controller Has Undertaken Adequate Protection”).

Deletion, Destruction, or Anonymization of Personal Data:
Even if personal data has been processed in compliance with the Law and other relevant legislation, it shall be deleted, destroyed, or anonymized by the data controller either automatically or upon the data subject’s request when the reasons requiring its processing no longer exist.
b. Provisions in other laws regarding the deletion, destruction, or anonymization of personal data remain reserved.
c. The procedures and principles concerning the deletion, destruction, or anonymization of personal data are regulated by a separate regulation.

Your Rights Under Article 11 of the Law:
By applying to our Company, you have the right to:
a. Learn whether your personal data is being processed,
b. Request information if it has been processed,
c. Learn the purpose of processing and whether it is used for its intended purpose,
d. Know the third parties to whom it has been transferred domestically or abroad,
e. Request correction if it is incomplete or inaccurate,
f. Request deletion or destruction under the conditions stipulated in the KVKK,
g. Request notification of the transactions made under items (e) and (f) to third parties to whom the data has been transferred,
h. Object to any result arising against you through the exclusive analysis of your data via automated systems,
i. Request compensation if you suffer damage due to unlawful processing of your personal data.
